Upon examination, the puppy appears to be fully healthy. You will have 3 business daysfrom the date you receive your puppy, in which you will have the puppy health checked by your veterinarian, at your own expense. Failure to do so will result in this contract being null and void.
All precautions have been made to ensure that this puppy is in excellent health at the time of purchase. Buyer needs to be aware that a puppy is a baby and that sometimes he/she may get sick due to stress or other related reasons. He/she is leaving our home and entering a new environment and stress related illnesses may occur. Breeder does not assume any liability for any injury or neglect to this puppy after pickup. It is the Buyer's responsibility to prevent illness and injury by providing necessary booster vaccinations, veterinary care, nutrition, fresh water, shelter and supervision. The Breeder has made every effort to breed healthy dogs and has raised this puppy to the best of his/her ability.
Breeder guarantees that the puppy is a purebred and registered with the American Kennel Club (AKC).
VACCINATIONS All puppies are current on vaccinations and deworming, and will come will a written record for you to provide to your veterinarian. Please do not take your puppy to any public places until the puppy has had ALL of its’ recommended vaccinations, at approximately 12-16 weeks of age, to ensure immunity against disease. This means do not expose them to any unvaccinated dogs or where those dogs may have been until fully vaccinated. You cannot be too careful and we will not be responsible for any disease that is contracted once in your possession. Please do not vaccinate your puppy with LEPTO, if you do this guarantee becomes null and void without exceptions.
WHAT THIS GUARANTEE DOES NOT COVER Cherry eye, umbilical hernia, inguinal hernia, loose hips, loose knees, allergies, soft palate issues, hypoplastic trachea, respiratory infections, kennel cough, demodex, tail abnormalities, stenotic nares, cosmetic issues, buyer's ignorance, neglect of incompetent veterinarians or any other disorders that may be caused by environmental factors such as thyroid or autoimmune disorders. We will not cover any death for any reason if the dog dies under anesthesia.
We do not cover bacterial, fungal, viral, or parasitic infections of any kind; if the dog left here up to date on vaccinations with a negative fecal from the vet, then they were deemed parasite free and fit for sale.
Any physical problem, which is or could be the result of injury sustained or an illness contracted after the consumer took possession of it, is not covered under this guarantee.
Breeder will not be responsible for any medical expenses incurred. Buyer is aware that owning a puppy means trips to the veterinarian and understands that he/she will be responsible for all payments.
Breeder cannot guarantee adult size, color, coat, temperament or trainability of puppy
WHAT THIS GUARANTEE COVERS We guarantee spine issues, heart defects, severe hip dysplasia, patellar luxation grade 3 and higher, elbow dysplasia, eyes, and hearing.
SPINE: Most, if not all, French bulldogs have at least one hemi-vertebrate, if not more. This is acceptable, especially if the hemi-vertebrates occur in the lumbar region to achieve the roach back look. Replacements for spine will be discussed on a case-by-case basis considering the quality of life of your dog, the opinion of your vet and whether surgery is necessary. Please do not let your dog jump from high surfaces, as this can increase the chances of a hemi-vertebrate becoming problematic.
PATELLAS: If your puppy's patellas are graded a 3 or 4 before 12 months of age, your dog will be replaced with a puppy or equal value.
HIP DYSPLASIA: In severe case, requiring surgery to return pup to an ambulatory state. We will require X- rays and 2 opinions from 2 unrelated veterinarians.
If purchasing a puppy with full/breeding rights, we guarantee that the dog/bitch will be able to reproduce. In the case, your dog/bitch is proven to not be able to reproduce by a veterinarian, then we will refund the difference of a pet price and price with full breeding rights, at Breeder’s discretion, assuming all requirements outlined in the following section are met.
REPLACEMENT PUPPY We understand a replacement puppy would never amend the tragedy of a loss; however, we agree in advance on a planned solution should your dog be certified by a licensed veterinarian as "unfit for purchase" due any of the following problem(s):
Requiring major surgery for a correction of a genetic defect
Recommended for euthanasia (hereditary or genetic condition)
Death from hereditary or genetic condition (autopsy required)
Puppy is guaranteed for 12 months from the date of birth against genetic defects only if the following guidelines are followed exactly:
Buyer must notify Breeder of any genetic defect immediately. We insist upon the opportunity to advise or recommend with any knowledge that we have to be of help no matter how large or small the problem. We do not want to be informed of the process after it is complete and final. Our recommendations may vary; if we are to be responsible, we want to be aware of the steps involved in the decision-making process and we need to be included in the decisions.
Buyer must report any trouble immediately to Breeder. Buyer must get all vet records to Breeder within 5 days of reporting trouble.
Buyer must have kept the puppy under the care of a licensed veterinarian. The care must include all vaccinations recommended by the vet on time.
Written notification at the time of diagnosis by Buyer’s veterinarian is required.
A written second opinion from another veterinarian must also be provided to us from the Buyer.
A written statement and signed certificate as to the genetic defect must be provided to us from the Buyer’s veterinarian stating the cause of death and a copy of ALL of your puppy's health records including an necropsy report.
If the condition is covered under this guarantee, Buyer must return affected dog to Breeder within 2 weeks of report at Buyer’s expense. Breeder's veterinarian will then examine the dog.
After these guidelines are followed, if there is a genetic defect present, the Breeder will offer the Buyer the right to return the animal in exchange for a replacement puppy of "equivalent" value, color, and purchase price at the first available opportunity. The replacement puppy would be over 8 weeks old and less than 20 weeks and be mutually agreed upon by both parties. It is also understood that the replacement puppy may not be from the same parents of the original pup. We will try and work with the buyer to ensure satisfaction. If the Buyer decides not to return a less than perfect puppy, this does not mean you forfeit your guarantee. We will apply the difference of the pet price and breeding price to any future puppies purchased from Woodlands Frenchies should you choose this route. This, however, will be at our discretion. Buyer is responsible for all transportation costs to and from the Breeder on a replacement puppy.
PLEASE NOTE: All items covered under this guarantee are for replacement only. Buyer is responsible for all monetary expenses to be paid. No monetary refunds, in part or full, will be given. If the puppy has been bred, spayed, neutered, or euthanized without Breeder’s permission, this guarantee is null and void, and no replacement puppy will be given.
RETURNING YOUR PUPPY A returned puppy must be returned to the Breeder in good condition, other than the specified problem, at the Buyer’s expense. If you euthanize the pup without notifying us, the guarantee is VOID.
AKC REGISTRATION PAPERS ALL PUPPIES MUST CARRY "WOODLANDS FRENCHIES" as part of their names or this contract is NULL AND VOID and you are in breach of contract.
FULL AKC: Offspring of this dog can be registered with the American Kennel Club (AKC) if bred to an AKC fully registered dog of the same breed and meets all other AKC rules for registration. If the dog is sold with Full AKC Registration status, the Breeder will register the dog for you in the Buyer’s name at the address in stated in this contract. A copy of the registration will be sent home with the Buyer at the time of pick-up. If we are sending your puppy to you, we will email you a copy of the registration and AKC will mail the registration certificate directly to the address stated in this contract.
LIMITED REGISTRATION: Dogs sold with limited registration may not be bred and must be spayed or neutered no later than 12 months of age and no earlier than 6 months of age. Breeder will release and send the registration papers within 10 business days to the Buyer upon proof of spaying/neutering of the dog to the Buyer’s address stated in this contract. Written proof must include dog’s date of birth, color, and full name.
OWNERSHIP RESPONSIBILITIES The puppy will become the property of the Buyer in flesh, as well as title and registration, upon the fulfillment of the following conditions (please initial where applicable):
RIGHT OF RECOVERY/PLACEMENT If, for whatever reason, the Buyer cannot or does not wish to maintain custody of the dog (at any time during its' lifetime) the Breeder is to be notified immediately of such case. The dog is NOT to be sold or placed anywhere, but to returned to the Breeder with all paperwork at Buyer’s expense. Breeder will not be responsible for any associated costs. Please note: there will be no refund of any kind for the return of said puppy or dog.
SPAYING AND NEUTERING Bitches and dogs which are judged not to be of show and breeding quality should be spayed or neutered no earlier than when they near maturity, at around twelve months of age. Bitches and dogs, which are judged to be show/breeding quality and sold with full rights, should be spayed or neutered no later than age 6. Full AKC registration will be determined and granted on a case-by-case basis.
NUTRITION Our dogs are fed a high-quality diet, which consists of kibbles. We require that your puppy continues with Life’s Abundance Nutritional System for the first 12 months of his/her life. If at any time your puppy/dog be removed from Life’s Abundance Nutritional System before the age of 12 months, the Health Guarantee becomes null and void without exceptions.
CARE AND USE OF THE DOG (please initial) Buyer agrees to keep the dog indoors and maintain the dog in a humane environment with proper training and care (quality food, water, shelter and veterinarian care) for the entire life of the dog. Specifically, the Buyer must maintain preventative health care of the puppy/dog, including, but not limited to inoculations against rabies, distemper, parvovirus, and other communicable diseases as recommended by a qualified veterinarian, internal and external parasites and heartworm preventative medicine. The dog will not be allowed to roam or stay as an outside dog 100% of the time, and will be socialized and obedience trained appropriately.
Buyer agrees that the dog will not be used or trained for activities which are illegal or for which it is not suited by reason of temperament or conformation. Specifically, it will not be used as a guard or attack dog or to hunt or fight other animals.
Buyer agrees that that the dog is not to be purchased for resale and that he/she will not sell, transfer ownership or possession of the puppy or any of his/her progeny to any person or organization whose intent it is to resell (pet store), trade, or give away the dog, or use it in any experiments, laboratory or otherwise or to use it as breeding stock for a puppy mill.
Buyer understands that seller has the right to repossess the dog in question and will take immediate legal action against the buyer in the State of Texas, if such conditions are found.
UNDERSTANDING THE CONTRACT TERMS Buyer agrees that he/she has read and understands the terms and conditions of this contract fully. This contract is under the jurisdiction of the state of Texas in the county of Harris. All other states and counties are asked to please accept this contract as legally binding and enforceable.
Violation of the terms of this contract renders all guarantees stipulated in this contract to be null and void. Seller then has the right to repossess the dog in question. In the event this contract and the parties involved have to be taken to court, Buyer is responsible for all court costs.
This contract is designed to protect the dog, the Breeder, and the Buyer of said puppy. Buyer understands and agrees to these conditions of sale. This warranty is only intended for original owner and is not transferable. By signing, all parties agree to all clauses of this contract.
